Frequently Asked Questions
What is an escrow service?
+An escrow service is a legal arrangement in which we, as a neutral 3rd party, hold money or assets on behalf of two parties in a transaction, ensuring that the money or assets are secure and readily available, then are released to the intended party after all specified conditions of release have been satisfied.
Do your escrow services include verifying transactions?
+No. Our role is strictly ministerial, acting as a neutral 3rd party "paymaster" for the transfer of funds in accordance with the terms of the escrow agreement. We are not privy to the details of the underlying transaction. We do not provide legal advice or representation to any party regarding the transaction. Our engagement does not constitute a verification or endorsement of the transaction.
Do you perform real estate title services?
+No. While we do provide attorney-managed escrow and trust services for commercial transactions, real estate title work is a very different practice. We recommend consulting with a licensed title company or a real estate attorney who specializes in these matters.
What is a business trust?
+A business trust is a legal arrangement in which we hold and manage funds on behalf of a client-beneficiary for a short term in order to attest to its financial capability (show proof of funds) or to carry out its financial obligation. We provide a secure and legally sound framework for managing these trusts, ensuring that clients' assets are protected and administered according to their strategic goals or instructions.
Do you set up or administer overseas trusts?
+No, we have no overseas operations. However, we may be able to refer you to an overseas practitioner who can assist you in such matters. In any case, we advise you to be mindful of the Foreign Account Tax Compliance Act (FATCA) and to consult with a tax attorney or other tax professional about compliance if it applies to you.
Do you provide estate planning or asset protection trusts?
+No, our focus is on escrow and commercial trust services. We do not engage in estate planning or the formation of asset protection trusts for individuals. For these matters, you should consult with an attorney who specializes in estate planning and asset protection.
